COURSES

1 FEES

Full payment of the course fees must be received two weeks prior to commencement of courses. Your place on the course cannot be guaranteed until full payment is received.

2 METHODS OF PAYMENT

Fees can be paid online or by bank transfer (please contact us for account details).

3 INTERSTATE GUESTS

3.1 Please include contact details for your SA stay when making your booking in case we need to contact you prior to course commencement.

3.2 Please ensure that your booking is confirmed and that the course is running before you make any travel arrangements. We cannot offer refunds for travel or accommodation costs.

 

4 CANCELLATIONS AND REFUNDS

4.1 Cancellations by you

4.1.1 You may cancel your place on a career or hobby course up to one month before the course start date. Under these circumstances you will be entitled to a full refund of course fees, minus the required deposit fee for the course purchased.

4.1.2 If you wish to cancel within one month of the course start date you will not be entitled to a refund.

4.1.3 If you have purchased a course and wish to cancel within one month of the course start date, you will not be entitled to a refund. However, at our discretion and subject to availability, you may be able to use the course fee on these courses only as a credit towards a future course. In this case, an administration fee may apply.

4.1.4 If you have booked a course within one month of its start date, condition 4.1.2 will apply.

4.2 Cancellations by us
4.2.1 Please note that courses have minimum attendance levels and may be cancelled if too few bookings are received. We reserve the right to amend dates or cancel courses.

4.2.2 In the instance that a student is asked to leave the course for reasons including but not limited to breach of Student Conduct condition 10.1, no refund will be given. 

4.2.3 If we cancel a course we will endeavour to give you at least one week’s notice where possible. You will have the option of transferring to another course or having a full refund of the fees.

4.2.4 We will not be liable for any losses (including, but not limited to, travel and accommodation costs) arising as a consequence of any modification or cancellation of courses or timetabling constraints as set out above, beyond the cost of the course fee.

4.3.1 Workshop cancellations and rescheduling requests must be made 5 full days prior to the day of the workshop.

4.3.2 Cancellations with less than 5 days notice are not refundable but can potentially be rescheduled. When 5 days or more notice is given, your refund will be 50% of the total price.

4.3.4 In the instance that materials have been ordered on attendees behalf, re-scheduling shall incur a charge of 40% of total cost to the client to cover costs.

5 COURSE TRANSFERS

5.1 You may transfer on to another course up to one month before a course start date subject to availability.

5.2 You may not transfer on to another course within one month of a course start date.

5.3 If you have booked a course within one month of its start date condition 5.2 will apply.

5.4 Students may transfer courses only once.

5.5 Students may not transfer to another course once it has started.

5.6 Transfer requests must be made in writing to hello@thewestendflowerschool.com.au

6 NON-ATTENDANCE

6.1 If you are unable to attend a class or classes due to illness, close contact of a covid19 case or for personal or professional reasons, you will not be entitled to a refund, extra tuition or to automatically transfer to another course. However, we will consider such action that we believe to be fair and reasonable.

6.2 Please note that if alternative options are offered, there may be an additional charge.

 

7 CERTIFICATES

7.1 To achieve a certificate of attendance you must attend at least 80% of the course.

7.2 You will be presented with a certificate at the end of the course and the name given on the booking form will be the one that appears on the certificate.

7.2.1 Your certificate will state Completion if you have satisfactorily met the assessment criteria. If you have not met the assessment criteria or your attendance was incomplete but over 80% you will receive a Recognition of Attendance certificate.

7.3 If you miss the last session of the course, your certificate can be posted to you at no additional charge.

7.4 Replacement certificates can be produced up to one year after completion of your course, but will be subject to an administrative fee of $50.

8 MATERIALS AND EQUIPMENT

8.1 All materials and flowers are included in the course fees.

8.2 Vases and props used by students during courses are on loan and remain the property of The West End Flower School.

9 PHOTOGRAPHY AND VIDEO

9.1 You may take as many photographs of your own work as you wish during the course.

9.2 Please ask permission of other students before taking photographs of their work, or using their work on your website or social media.

9.3 You are not permitted to take videos during classes at The West End Flower School or use your tutor’s work for promotion of yourself or your business.

10 STUDENT CONDUCT AND RESPONSIBILITIES

10.1Students are expected to conduct themselves in a professional manner and to recognise that other students also require support and assistance. If a student becomes persistently late, does not pay attention in class, is repeatedly argumentative or otherwise disruptive, we reserve the right to issue an oral or written warning and, if this does not resolve the situation, we may, at our discretion, ask the student to leave the course.

10.2 Students are required to comply with all directions given by The West End Flower School

representatives while on school property or participating in activities controlled by us.

10.3 Students agree that information of, or held by, The West End Flower School or any other students is not accessed, used or published inappropriately.

10.4 Any students who engage in publicising negative or critical views of The West End Flower School on social media platforms may be subject to legal action being taken against them, at our discretion.

11 HEALTH AND SAFETY

11.1 Students are expected to follow Health and Safety guidelines that are given at the start of each course.

11.2 Students are asked to wear appropriate clothing and footwear during the course.

11.3 Students who fail to comply with Health and Safety rules will be unable to participate in the course.

12 COVID 19 AND ILLNESS POLICY

12.1 Students are required to wear a mask if requested for the duration of every class and make use of available hand sanitiser

12.2 Students who fail to comply with mask policy when requested may be unable to participate in the class or course

12.3 Students with a transmissible illness including but not limited to cold, flu and gastroenteritis are required to not attend classes until they are well in the spirit of limiting the spread of illnesses to other potentially vulnerable attendees.

13 FORCE MAJEURE

We will not be liable for any failure or delay in the performance, in whole or part, of any of our obligations arising from or attributable to acts, events, omissions or accidents beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes (whether involving our workforce or the workforce of any other party), act of God, war, riot, civil commotion, terrorism, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery or heating, lighting, air conditioning or telecommunications equipment, fire, flood, storm, pandemics, epidemics or other outbreaks of disease or infection, or failure in the external supply of electricity, water or telecommunications (including internet) connections.

 

 

14 NON DISCLOSURE

Students of The West End Flower School agree that attendance is for their own educational benefit and not for the purpose of gathering information in order to teach the skills gained while attending our courses or workshops.

15 APPLICABLE LAW

These Terms and Conditions shall be read and construed in accordance with South Australian law. Enlisting the services of the West End Flower School implies agreement on these Terms and Conditions.

The West End Flower School offers this website, including all information, tools and services available from this site to you, the user, conditional upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by our Terms of Service. The Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of The West End Flower School website.

You may not alter, amend, impair or interfere with our website in any way. If you default negligently in any obligations set out in these Terms of Service, you shall be liable for all losses and damages that this may cause to The West End Flower School.

PRICES

The price of any or all of our products will be as quoted on our website except in cases of obvious error. The prices of The West End Flower School courses are liable to change at any time and we reserve the right to modify or discontinue a service without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of a service.

REFUSAL OF TRANSACTION

We reserve the right to refuse to process an order for any reason, or refuse service to anyone at our sole discretion and at any time during the ordering process.

ORDERING ONLINE

Upon placing your order online, you will be sent a confirmation e-mail detailing your order. When your payment has been made in full, your place on the course is then confirmed.

By placing an order through our website, you warrant that you are both legally capable of entering into a binding contract, and are at least eighteen years of age.

ERRORS, INACCURACIES AND OMISSIONS

Although we make every effort to be accurate, there may be information on our website that contains typographical errors, inaccuracies or omissions which may relate to course descriptions, pricing, promotions, offers and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information on our website if it is inaccurate at any time without prior notice (including after you have booked a course).

We undertake no obligation to update, amend or clarify information on our website, including without limitation, pricing information, except as required by law.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights regarding the West End Flower School website including, but not limited to, text, graphics, design, logos, photographs, images and all other materials are owned by The West End Flower School. No trademarks or content may be copied, reproduced, sold or used without our prior written consent. If we believe our intellectual property rights to have been breached you must at our direction return, delete or destroy any copies of the materials you have duplicated.

PROHIBITED USES

LAW AND JURISDICTION

The contracts made through the purchasing of products through our website will be governed by South Australian Law. Any dispute that may arise from such contracts will be subject to the non-exclusive jurisdiction of the courts of South Australia.

 

GIFT VOUCHERS: SPECIAL TERMS AND CONDITIONS

Gift vouchers are purchasable online and sent directly by email to the purchaser. The West End Flower School gift vouchers are issued in AUD$ and are redeemable online against in-house workshops and courses only. Your gift voucher is valid for 12 months from the date of purchase. Your gift voucher is non-refundable and cannot be exchanged for cash/credit, and cash/credit refunds will not be available for purchases made with the voucher.
